Terms of Use & Regulatory Shield

Last Updated: October 2026 • Governing Law: India

Founder Review Draft: This document outlines the legal safeguards governing PhysioPilot as an educational study aid (exempt from CDSCO SaMD medical device registration) under the National Commission for Allied and Healthcare Professions Act, 2021, and Section 52 of the Indian Copyright Act, 1957.

1. Educational Reference Classification (CDSCO SaMD Exemption)

⚠️ CRITICAL MEDICAL DISCLAIMER: PhysioPilot is classified as Software as an Educational Tool (SaET). It is explicitly NOT a medical device and is exempt from Central Drugs Standard Control Organisation (CDSCO) SaMD registration. It must never be used as a primary diagnostic tool, surgical planner, or clinical decision support system on live human patients.

All physical examination procedures, special tests, electrotherapy dosage parameters (carrier/beat frequencies), and goniometric norms presented within the software are synthetic educational models derived from canonical academic literature. They represent theoretical benchmarks for university examination preparation and must never be applied without individual licensed clinical judgment.

2. Clinical Supervision Under NCAHP Act, 2021

Under the National Commission for Allied and Healthcare Professions (NCAHP) Act, 2021, undergraduate physiotherapy students are legally required to conduct patient examinations, manual mobilizations, and electrotherapy modalities exclusively under the direct supervision of registered, qualified physiotherapists in recognized hospitals or rehabilitation facilities.

PhysioPilot accepts no legal liability for improper manual technique, unverified electrotherapy application, or contraindication disregard performed on live human subjects.

3. Academic Provenance & Fair Dealing (Indian Copyright Act, 1957)

In accordance with Section 52(1)(a) and Section 52(1)(h) of the Indian Copyright Act, 1957:

  • Non-Copyrightability of Medical & Biomechanical Facts: Human anatomical structures, physiological reflexes, joint kinematics, and established clinical test procedures (e.g. Lachman test, Phalen maneuver, ASIA impairment scale) exist in the medical public domain and cannot be copyrighted by commercial publishers.
  • Original Pedagogical Synthesis: PhysioPilot does not reproduce verbatim copyrighted prose, proprietary diagrams, or scanned publisher plates. All explanations, rubrics, and blueprints are original formulations authored by our educational team.
  • Citations & Attribution: References to standard authorities (Clayton, Norkin, Magee, BD Chaurasia, Levangie) are cited strictly for academic provenance and student curriculum guidance, and do not imply commercial endorsement by original authors or publishers.

4. Beta Pilot License & User Conduct

During the controlled closed pilot phase, PhysioPilot grants participating students a non-exclusive, non-transferable, revocable license to install and test the Android APK on their personal mobile devices for private study purposes.

You agree not to decompile, reverse-engineer, extract SQLite database seed files, or redistribute proprietary APK packages without explicit written authorization.

5. Independent Educational Platform

PhysioPilot is an independent educational platform. Mentions of West Bengal University of Health Sciences (WBUHS), Rajiv Gandhi University of Health Sciences (RGUHS), Maharashtra University of Health Sciences (MUHS), or other academic institutions denote curriculum past-paper indexing and syllabus alignment, not formal institutional affiliation, sponsorship, or university partnership.
